Court won’t hear appeal from man convicted of rape

WASHINGTON — The Supreme Court won’t hear the latest appeal from a man convicted in the rape and killing of a 15-year-old Kansas City girl.

The high court on Monday refused to hear an appeal from Michael A. Taylor, one of two men convicted of raping and killing teenager Ann Harrison in 1989. Taylor asked for a jury trial on punishment but was sentenced to death in 1994 by a judge, who found several aggravating circumstances that warranted the death penalty.

The Supreme Court in 2002 ruled that juries and not judges would decide if aggravating circumstances of a murder existed that would demand a death penalty. Taylor has asked Missouri courts to apply the Supreme Court decision to his sentence, but they have refused.

The case is Taylor v. Missouri, 08-1084.
